Financial Fraud: Johnnie Franklin Sullivan Pleads Guilty to Workers’ Compensation Fraud

<p>CHARLOTTE, N.C. – Johnnie Franklin Sullivan, Sr., 73, of Mooresville, N.C., appeared before U.S. Magistrate Judge Susan C. Rodriguez today and pleaded guilty to workers’ compensation fraud for a job-connected injury, announced Dena J. King, U.S. Attorney for the Western of North Carolina.</p>



<p>Jeff Krafels, Special Agent in Charge of the United States Postal Service, Office of the Inspector General (USPS OIG) for the Mid-Atlantic Area Field Office (MAAFO), which oversees Charlotte, joins U.S. Attorney King in making today’s announcement.</p>



<p>According to filed court documents and today’s plea hearing, Sullivan, Sr. was employed by the U.S. Postal Service as a mail processing clerk in Charlotte. In May 2005, Sullivan, Sr. sustained an injury at work. Later that year, Sullivan, Sr. began to receive workers’ compensation benefits administered by the U.S. Department of Labor’s Office of Workers’ Compensation Programs (OWCP) for employees covered by the Federal Employees’ Compensation Act (FECA). In order to receive and maintain FECA benefits, Sullivan, Sr. was required to submit periodic reports regarding his physical condition and his inability to perform a Postal Service job.</p>



<p>Court documents show that, on multiple occasions, Sullivan, Sr. made false statements and material misrepresentations regarding his physical abilities and medical restrictions. Among the false claims Sullivan, Sr. made was that he was unable to sit for long periods of time, that he could only drive short distances, that he needed to use a cane when he walked, and that he was unable to travel or engage in hobbies and other recreational activities due to his medical condition. As a result of the false statements, over the years Sullivan, Sr. received payments totaling more than $103,261.</p>



<p>According to court records, during the time that Sullivan, Sr. made these false claims, he was posting on social media photos of his many long-distance trips and physically rigorous activities. For example, Sullivan, Sr. posted photos of himself traveling to places in Europe and the United States; walking long distances over different types of terrain; ziplining in Niagara Falls, New York; using surf boards and boogie boards during beach vacations; and participating in shag dancing events.</p>



<p>“For years, Sullivan, Sr. lied about his pain and suffering caused by an on-the-job injury to bilk the federal workers’ compensation program out of thousands of dollars, and used the funds to pay for recreational activities,” said U.S. Attorney King. “When individuals defraud an important program meant to protect injured federal workers, my Office will make sure they are held accountable for their actions.”</p>



<p>“Most postal employees who collect workers’ compensation benefits have legitimate claims. A small percentage, however, abuse the system and cost the Postal Service millions of dollars in fraudulent claims and enforcement costs. Therefore, USPS OIG Special Agents will continue to relentlessly pursue those identified as fraudulently collecting workers’ compensation funds from the Postal Service,” said USPS OIG Special Agent in Charge Krafels.</p>



<p>Sullivan, Sr. pleaded guilty to making a false report in connection with federal compensation benefits and theft of government funds. He was released on bond after the court hearing. A sentencing date has not been set.</p>



<p>The USPS OIG investigated the case. Assistant U.S. Attorney Kenneth M. Smith of the U.S. Attorney’s Office in Charlotte is in charge of the prosecution.</p>

<h2>Action Continues Government’s Disruption of Weapons Shipments from Iran to Yemen</h2>
<p>The Justice Department today announced the filing of a forfeiture complaint against over 9,000 rifles, 284 machine guns, approximately 194 rocket launchers, over 70 anti-tank guided missiles, and over 700,000 rounds of ammunition that the U.S. Navy seized in transit from Iran’s Islamic Revolutionary Guard Corps (IRGC) to militant groups in Yemen.</p>
<p>“The government of Iran, through its Islamic Revolutionary Guard Corps, remains bent on smuggling weapons of war to militant groups in violation of U.S. sections and international law,” said Assistant Attorney General Matthew G. Olsen of the Justice Department’s National Security Division. “As this seizure demonstrates, the Department of Justice will work in lockstep with our U.S. Government partners to deny the Iranian regime the means to undermine our nation’s interest and threaten the security of our people.”</p>
<p>“The United States Attorney’s Office has again taken action to prevent Iran’s Islamic Revolutionary Guard Corps from spreading violence and bloodshed across the world and threatening the security of our nation and allies,” said U.S. Attorney Matthew M. Graves of the District of Columbia. “As proven before, where we have jurisdiction, this office will use all the tools available in our power to prevent criminals and terrorists from threatening global stability.”</p>
<p>“It is paramount this significant amount of seized weapons and ammunition aimed to cause global devastation never reach its intended destination,” said HSI Washington, D.C. Special Agent in Charge Derek W. Gordon. “HSI Washington D.C., with DCIS and the assistance from U.S. Naval Forces Central Command, will continue to identify, disrupt, and dismantle Iran’s illicit flow of weapons at every level to prevent Iran’s illicit activity in the region and globally.”</p>
<p>“This seizure demonstrates DCIS’ continued commitment to stopping illicit weapons trafficking by the IRGC,” said Christopher W. Dillard, Special Agent in Charge, Department of Defense Office of Inspector General, Defense Criminal Investigative Service (DCIS), Mid-Atlantic Field Office. “DCIS, along with its law enforcement partners, will use all tools to hinder the efforts of those who unlawfully threaten the safety and security of the United States.”</p>
<p>According to court documents, the noted weapons came from four interdictions of stateless dhow vessels: two from 2021 and two from 2023. These interdictions led to the discovery and seizure of four large caches of conventional weapons, including long arms and anti-tank missiles, and related munitions – all of which were determined to be primarily of either Iranian, Chinese, or Russian origin.</p>
<p>This action follows the government’s March 2023 forfeiture action against over one million rounds of ammunition en route from Iran to Yemen. These forfeiture actions address the illicit trafficking of advanced conventional weapons systems and components by sanctioned Iranian entities that directly support <a class="wpil_keyword_link" href="https://www.fraudswatch.com/category/military-scammer/" title="military" data-wpil-keyword-link="linked" data-wpil-monitor-id="416">military</a> action by the Houthi movement in Yemen and the Iranian regime’s campaign of terrorist activities throughout the region. The forfeiture complaint alleges a sophisticated scheme by the IRGC to clandestinely ship weapons to entities that pose grave threats to U.S. national security.</p>
<p>This forfeiture action is a product of the U.S. government’s coordinated effort to enforce U.S. sanctions against the IRGC and the Iranian regime and are merely allegations.</p>
<p>The HSI Washington Field Office and the DCIS Mid-Atlantic Field Office are leading the larger investigation of the Iranian weapons-smuggling network, with substantial assistance from the U.S. Naval Forces Central Command in conducting the seizure. This team was also responsible for the March 2023 forfeiture action, which remains pending in the U.S. District Court for the District of Columbia.</p>
<p>Assistant U.S. Attorneys Stuart D. Allen, Brian P. Hudak, Rajbir S. Datta, and Anna D. Walker for the District of Columbia and Trial Attorneys S. Derek Shugert and Joshua Champagne of the National Security Division are litigating the case, with support from Paralegal Specialists Brian Rickers and Angela De Falco.</p>

 Texas Man Sentenced on Felony Charge For Actions During Jan. 6 Capitol Breach</p>
<h2>Defendant Rifled Through Senator’s Desk on Senate Floor</h2>
<p> A Texas man was sentenced today for felony obstruction of an official proceeding during the breach of the United States Capitol on Jan. 6, 2021. His actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the 2020 presidential election.</p>
<p> Joshua Johnson, 32, of Sherman, Texas, formerly of Spokane, Washington, was sentenced to 24 months in prison for obstruction of an official proceeding. Johnson pleaded guilty, on March 21, 2023, in the District of Columbia. In addition to the prison term, U.S. District Court Judge Christopher R. Cooper ordered 24 months of supervised release, restitution of $2,000 to the Architect of the Capitol, and a $100 fine.</p>
<p> According to court documents, on Jan. 6, 2021, Johnson arrived at the east side of the U.S. Capitol building with other protestors. As he approached, police and rioters were spraying each other with what the defendant believed to be mace. He entered the Capitol at approximately 2:40 p.m. through the Rotunda doors. From there, he climbed a set of stairs and made his way through the hallways of the Capitol—checking door handles of locked doors as he made his way to the Senate gallery.</p>
<p> Court records say that at about 2:43 p.m., Johnson put on and removed a gas mask as he made his way toward the Senate floor, which he reached by about 2:49 p.m. As he approached the Senate chamber, Johnson’s goal was to “be heard” by members of the United States Congress, who Johnson was surprised to see had already evacuated the chamber, and influence Vice President Pence “to do the right thing.” He wanted to “stop the steal,” meaning stop the certification of the Electoral College vote.</p>
<p> Once in the Senate chamber, Johnson rifled through documents on a Senator’s desk and recorded video of himself and others in the chamber using his cell phone. By about 3:02 p.m., Johnson left the chamber and exited the building through the north doors at about 3:07 p.m., raising his hands in the air as the crowd of rioters still outside the building cheered.</p>
<p> Johnson was arrested on March 23, 2022, in Plano, Texas.</p>
<p> This case was prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section. Valuable assistance was provided by the U.S. Attorney’s Office for the Eastern District of Texas.</p>
<p> The case was investigated by the FBI Seattle Field Office-Spokane Resident Agency and the FBI Washington Field Office. Valuable assistance was provided by the Metropolitan Police Department and the U.S. Capitol Police.</p>
<p> In the 30 months since Jan. 6, 2021, more than 1,069 individuals have been arrested in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including more than 350 individuals charged with assaulting or impeding law enforcement. The investigation remains ongoing.</p>

<h2>Group Ran Open-Air Operation Based on South Capitol Street</h2>
<p> WASHINGTON –The fifth of five defendants engaged in a drug trafficking conspiracy entered a guilty plea today in U.S. District Court in the District of Columbia.</p>
<p> Kurtis Mathes, 33, of Washington, D.C, pleaded guilty to conspiracy to distribute and possession with intent to distribute marijuana, acknowledging that the drug distribution transactions took place within 1,000 feet of a school. A sentencing hearing is scheduled for Nov. 3, 2023.</p>
<p> The investigation focused on a drug trafficking organization that operated outside a gas station and within 1,000 feet of a school on South Capitol Street.</p>
<p> The plea was announced by U.S. Attorney Matthew M. Graves, Special Agent in Charge Christopher Amon, of the Washington Field Division of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Special Agent in Charge Jarod Forget, of the Washington Division of the U.S. Drug Enforcement Administration (DEA), and Interim Chief Ashan Benedict, of the Metropolitan Police Department (MPD).</p>
<p> Mathes was charged with Tayion Hamiel-Ward, 25, of Washington, D.C.; Karl Dunn, 45, of Suitland; Brian Williams, 27, of Largo, Maryland; and DeShawn Barnes, 28, also of Washington, D.C., all of whom have pleaded guilty and are awaiting sentencing.</p>
<p> According to court documents, the defendants were operating an open-air drug market near a gas station and tobacco store in the 4600 block of South Capitol Street S.W. Several shootings in that area, dating back to at least March 2021, sparked an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, in conjunction with the Metropolitan Police Department, focusing on violent crime and drug trafficking activities near the Exxon Gas Station (“Exxon”) and the SC Discount Tobacco and Grocery Store (“Tobacco Store”), located at 4665 South Capitol Street SW and 4675 South Capitol Street SW, Washington D.C., respectively. The Exxon and the Tobacco Store, which are next to each other, are located within 1,000 feet of Ingenuity Prep Public Charter School, a public charter school in the District of Columbia. Law Enforcement observed individuals loitering in front of and inside the Exxon and Tobacco Store and selling controlled substances to gas station customers.</p>
<p> Through the investigation, Law Enforcement identified five defendants, including Mathes, as being involved in this drug trafficking operation. As part of the conspiracy, Mathes and his co-defendants sold narcotics in a coordinated manner at various locations. Such coordination included the co-conspirators’ having common sources of supply, re-supplying or helping each other fill orders for narcotics, and referring customers to each other. Members of the conspiracy also possessed firearms in furtherance of the conspiracy. Law Enforcement executed controlled purchases of marijuana from members of this drug trafficking group. These purchases were recorded and monitored.</p>
<p> On or around July 13, 2022, Law Enforcement executed a search warrant at Mathes’ residence, where they found: 3,056 grams of marijuana, assorted packing materials, and ammunition. Over the course of the investigation, law enforcement also recovered firearms, magazines, marijuana, and more than $79,000 in cash. </p>
<p> The case is being investigated by the ATF’s Washington Field Division, the DEA’s Washington Division, and the Metropolitan Police Department. Valuable assistance was provided by the FBI’s Washington Field Office, the Prince George’s County, Maryland Police Department, and the U.S. Secret Service.</p>
<p> The case is being prosecuted by Special Assistant U.S. Attorney Sarah J. Rasalam of the Violence Reduction and Trafficking Offenses Section (VRTO). Philadelphia Man Pleads Guilty to Involuntary Manslaughter and Assault with a Dangerous Weapon

 Philadelphia Man Pleads Guilty to Involuntary Manslaughter and Assault with a Dangerous Weapon </p>
<p> WASHINGTON – Reginald Johnson, 31, of Philadelphia, P.A., pleaded guilty, today, to involuntary manslaughter (criminal negligence) and assault with a dangerous weapon in connection with a vehicular homicide. The plea was announced by U.S. Attorney Matthew M. Graves and Interim Chief Ashan Benedict, of the Metropolitan Police Department.</p>
<p> According to the Government’s evidence, on January 15, 2023 around 6:10 p.m., Reginald Johnson drove his Jeep eastbound into the intersection of Massachusetts Avenue, Northwest and 15th Street, N.W crashing into an Uber driver in a Toyota Corolla who was turning left across eastbound traffic lanes onto 15th Street, NW. Mr. Johnson reached a speed of 61 miles per hour shortly before the crash, more than twice the 25 miles per hour speed limit. Mr. Johnson told an officer that he saw the car turning but thought it was stopping, sped up, and struck the car towards its tail end.</p>
<p> Reginald Johnson had been drinking alcoholic beverages at Mission Bar from approximately 1:24 p.m. to 5:46 p.m. before choosing to get behind the wheel. His breath alcohol content was at 9:20 p.m. was 0.10 grams of alcohol per 210 liters of breath. D.C. Code § 50–2206.01 defines intoxicated as “An alcohol concentration at the time of testing of 0.08 grams or more … per 210 liters of the person’s breath…”</p>
<p> On June 30, 2023, the defendant pleaded guilty, in the Superior Court for the District of Columbia, to involuntary manslaughter (criminal negligence) in the death of one passenger, Carlos Christian, and assault with a dangerous weapon in the injury of another passenger, Camila Selman. Superior Court Judge Robert Okun scheduled a sentencing hearing for October 13, 2023, at which time the defendant faces a sentence of up to 12 years in prison. </p>
<p> In announcing the plea, U.S. Attorney Graves and Interim Chief Benedict commended the work of Detective William Lee and others from MPD’s Major Crash Unit who investigated the case in Washington, D.C. They also acknowledged the efforts of Assistant U.S. Attorney Jamie Carter, of the Homicide section, who is prosecuting the case.</p>

<h2>Defendant Assaulted Law Enforcement with Flagpole</h2>
<p> WASHINGTON — A Michigan man has been arrested on multiple felony and misdemeanor charges, including assaulting a law enforcement officer, for his actions during the breach of the U.S. Capitol on Jan. 6, 2021. His actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the presidential election.</p>
<p> Jeremy Rodgers, 28, of Midland, Michigan, is charged with felony offenses: assault on a federal officer with a deadly or dangerous weapon, civil disorder, entering and remaining in a restricted building or grounds with a deadly or dangerous weapon, disorderly and disruptive conduct in a restricted building or grounds with a deadly or dangerous weapon, and act of physical violence in a restricted building or grounds with a deadly or dangerous weapon. Rodgers is also charged with misdemeanor offenses of disorderly conduct in a Capitol building, act of physical violence in a Capitol building or on Capitol grounds, and parading, demonstrating, or picketing in a Capitol building.</p>
<p> Rodgers was arrested in Orlando, Florida, and will make his initial appearance today in the Middle District of Florida.</p>
<p> According to court documents, authorities identified a man, later determined to be Rodgers, from video and surveillance footage on Jan. 6, 2021, assaulting a law enforcement officer with a flagpole. Court documents state that on January 6th, Rodgers, carrying a blue flag attached to a wooden flagpole, approached a line of law enforcement officers guarding the entrance to the East Rotunda Door and then used his flagpole as a weapon, audibly striking a United States Capitol Police (USCP) Officer three times on the helmet. Court documents say that shortly after, Rodgers again struck down the flagpole twice more in the direction of the officers.</p>
<p> Court records allege that Rodgers is believed to have attempted to use his flagpole to prevent officers from closing the East Rotunda Door and entered the Capitol building through that door at approximately 2:26 p.m. Once inside the building, court documents allege that Rodgers walked toward Statuary Hall and the House side of the building and was observed removing a railing blocking the path of the crowd behind him, stating, “come on in.” Court documents state that Rodgers then stood aside and shouted “USA, USA” while waving people toward the House Chambers.</p>
<p> According to court documents, Rodgers then joined a crowd of rioters that pushed through a police line guarding the entrance to the House of Representatives Chambers and spent several minutes outside the entrance to the House Chamber. Afterward, Rodgers was involved in another scuffle with police, remained in the building, and paraded through the Rotunda waving his flag before finally exiting the building at approximately 2:56 p.m.</p>
<p> This case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section. Valuable assistance was provided by the U.S. Attorney’s Office for the Eastern District of Michigan, Middle District of Florida, and the FBI’s Tampa Field Office.</p>
<p> The case is being investigated by the FBI’s Detroit and Washington Field Offices, which identified Rodgers as BOLO (“Be On the Look Out”) #242 on its seeking information photos.</p>

<p> WASHINGTON — A Texas man has been arrested on felony and misdemeanor charges for his actions during the breach of the U.S. Capitol on Jan. 6, 2021. His actions and the actions of others disrupted a joint session of the U.S. Congress convened to certify the electoral votes related to the presidential election.</p>
<p> Jeffrey David Reed, 48, of Rosanky, Texas, is charged with one count of civil disorder, a felony offense. Reed is also charged with various misdemeanor offenses, including entering or remaining in a restricted building or grounds; disorderly or disruptive conduct in a restricted building or grounds; entering and remaining in a restricted building or grounds with a deadly or dangerous weapon; disorderly conduct in a capitol building; and parading, demonstrating, or picketing in a Capitol building.</p>
<p> Reed was arrested in Rosanky, Texas, and made his initial appearance today in the Western District of Texas.</p>
<p> According to court documents, video footage from Jan. 6, 2021, shows a man, later identified as Reed, taking down multiple barricades and passing through restricted areas secured by U.S. Capitol Police before heading into the U.S. Capitol building. Video footage depicts Reed physically moving the metal barricades in front of the U.S. Capitol Police line, impeding and interfering with law enforcement efforts to maintain a police line and keep rioters from crossing into restricted areas. At one point, a video taken from that day shows Reed yelling at police officers, stating, “you work for us.”</p>
<p> Court documents state that based on the video footage and photos of Reed outside the U.S. Capitol building, a review of video footage from inside the Capitol building was conducted by federal authorities. During this review, authorities identified Reed inside the building, speaking on his cell phone moments after a woman was shot inside the building and exiting a while later.</p>

U.S. Attorney Announces Participation in Coordinated National Health Care Fraud Enforcement Action

<p><b>SAVANNAH, Ga.</b> – Criminal charges have been filed in the Southern District of Georgia against a Florida man as part of the Department of Justice’s 2023 National Health Care Fraud Enforcement Action.</p>
<p>“These enforcement actions, including against one of the largest health care fraud schemes ever prosecuted by the Justice Department, represent our intensified efforts to combat fraud and prosecute the individuals who profit from it,” said Attorney General Merrick B. Garland. “The Justice Department will find and bring to justice criminals who seek to defraud Americans and steal from taxpayer-funded programs.”</p>
<p>“This nationwide enforcement action demonstrates that the Criminal Division is committed to fighting health care fraud and opioid abuse by prosecuting those who allegedly exploit patients and health care benefit programs for personal gain,” said Assistant Attorney General Kenneth A. Polite, Jr. of the Justice Department’s Criminal Division. “Today’s announcement includes some of the largest and most complex cases that the Department has prosecuted, and demonstrates the Department’s commitment to seeking justice for those at all levels of the healthcare industry who put profits above patient care, from professionals in doctors’ offices to executives in corporate boardrooms.”</p>
<p>“In collaboration with our law enforcement partners, we are committed to protecting the integrity of our nation’s health care system and medical safety net programs from those who would exploit them for profit,” said Jill E. Steinberg, U.S. Attorney for the Southern District of Georgia.</p>
<p>The charges announced during the 2023 National Health Care Fraud Enforcement Action are part of a strategically coordinated, two-week nationwide law enforcement sweep that resulted in criminal charges against 78 defendants for their alleged participation in health care fraud and opioid abuse schemes that resulted in the submission of more than $2.5 billion in alleged false billings. The defendants allegedly defrauded programs entrusted for the care of the elderly and disabled, and, in some cases, used the proceeds of the schemes to purchase luxury items, including exotic automobiles and yachts.</p>
<p>In the Southern District of Georgia<b>, Christopher Ciani</b>, 40, of Land O’ Lakes, Fla., is charged via Information with one criminal count of Conspiracy. The information alleges that Ciani, in 2019, operated a company called Ciani Medical Solutions and conspired with others in a scheme targeted at the Medicare program. As alleged in the information, Ciani brokered relationships between laboratories and various marketing groups that recruited Medicare beneficiaries and sent doctors’ orders and specimens for genetic testing to the laboratories in exchange for approximately $1.4 million in illegal kickbacks and bribes.
